Israel formally indicts ex-minister Lieberman

JERUSALEM (AP) ? Israel's former foreign minister Avigdor Lieberman was formally indicted on Sunday on charges of breach of trust and fraud, allegations that could hurt his political future if he is convicted.

Lieberman resigned his Cabinet post earlier this month after he was informed of the pending charges, though he denies any wrongdoing and remains a member of parliament.

He is accused of trying to advance the career of a former diplomat after the envoy relayed information to him about a criminal investigation into his business dealings.

The ministry released the text of Lieberman's indictment on breach of trust and fraud charges two weeks ago in order to lift his diplomatic immunity. It added details to the indictment on Thursday after receiving testimony that suggested he was more deeply involved than previously known in trying to promote the diplomat. The actual charges, filed in a Jerusalem court on Sunday, remained unchanged.

The diplomat, former ambassador to Belarus Zeev Ben-Aryeh, reached a plea bargain with the state in the case earlier this year.

The indictment did not address the main suspicions against Lieberman that had been the focus of a years-long investigation. Attorney General Yehuda Weinstein ultimately decided that prosecutors did not have a strong enough case to charge Lieberman with illicitly receiving millions of dollars from businessmen and laundering the cash through straw companies in eastern Europe.

While he was charged with lesser offenses, Lieberman's political future could be compromised if the court that hears the case decides to convict him of a crime that carries what is known in Israeli law as "moral turpitude." Lawmakers convicted of such crimes must resign immediately from parliament, then are barred from re-entering politics for seven years.

Lieberman's Yisrael Beiteinu party is running on a joint list with Prime Minister Benjamin Netanyahu's Likud in the Jan. 22 election, and he is expected to be re-elected to parliament. Political commentators had viewed the hookup as grooming him to become a future prime minister. Lieberman takes a hard line on concessions to the Palestinians and perceives Israel's large Arab minority as a threat to the Jewish state.

In other political news, Israel's Supreme Court unanimously rejected an election committee's attempt to disqualify an Arab lawmaker from running for parliament again next month because she took part in a flotilla that tried to breach Israel's naval blockade of the Hamas-run Gaza Strip.

The lawmaker, Hanin Zoabi, enraged many Israelis by joining the Turkish-led Mavi Marmara flotilla, which was stormed by Israeli naval commandos who clashed with pro-Palestinian activists, killing nine. The Israeli military says the soldiers acted in self-defense after being attacked on the deck.

Zoabi was nearly assaulted in parliament by another lawmaker and subsequently was stripped of some of her parliamentary privileges.

Earlier this month, an Israeli elections committee voted to disqualify her from running in next months' election. She appealed that decision to the Supreme Court, which overturned it, as it has rejected the committee's attempts in previous years to bar certain Arab candidates from running.

Lawmaker Danny Danon, who collected thousands of signatures demanding that Zoabi's candidacy be disqualified, accused the court of "backing the Marmara terrorist rather than naval commando fighters."

The court said in its ruling that it would release its reason for overturning the decision at a later date. Under Israel's election law, the court had to issue its ruling by Sunday.

Iraqi Sunnis stage big anti-government rallies

RAMADI, Iraq (Reuters) - Tens of thousands of protesters from Iraq's Sunni Muslim minority poured onto the streets after Friday prayers in a show of force against Shi'ite Prime Minister Nuri al-Maliki, keeping up a week-old blockade of a highway.

Around 60,000 people blocked the main road through the city of Falluja, 50 km (32 miles) west of the capital, setting fire to the Iranian flag and shouting "out, out Iran! Baghdad stays free" and "Maliki you coward, don't take your advice from Iran".

Many Sunnis, whose community dominated Iraq until the fall of Saddam Hussein in 2003, accuse Maliki of refusing to share power and of favoring Shi'ite, non-Arab neighbor Iran.

Protests flared last week after troops loyal to Maliki, who is from the Shi'ite majority, detained bodyguards of his finance minister, a Sunni.

Activists demands include an end to the marginalization of Sunnis, the abolition of anti-terrorism laws they say are used to target them, and the release of detainees.

"I came to Falluja to express my support for their demands. I hope we proceed to Baghdad," said 48-year-old Faiq al-Awazi.

Demonstrations were also held in the northern city of Mosul and in Samarra, where protesters chanted "the people want to bring down the regime", echoing the slogan used in popular revolts that ousted leaders in Tunisia, Egypt, Libya and Yemen.

Speaking at a "reconciliation" conference broadcast on television, Maliki said: "It is not acceptable to express something by blocking roads, inciting sedition and sectarianism, killing, or blowing the trumpet of war and dividing Iraq".

The protests are likely to add to concerns the civil war in neighboring Syria, where majority Sunnis are fighting to topple a ruler backed by Shi'ite Iran, will drive Iraq back to the sectarian slaughter of 2005-07.

Militants linked to al Qaeda appear to be regrouping in Anbar and to be joining rebel ranks across the border in Syria.

Protesters in the city of Ramadi in Anbar province raised pictures of Turkish Prime Minister Tayyip Erdogan, who has lined up against Syrian President Bashar al-Assad and has sparred increasingly often with Maliki.

In Iraq's Shi'ite south, a small anti-Erdogan protest was held in the holy city of Najaf, 160 km (100 miles) from Baghdad.

Sunni complaints against Maliki grew louder a week ago following the arrest of Finance Minister Rafaie al-Esawi's bodyguards hours after Iraqi President Jalal Talabani, a Kurd seen as a steadying influence, was flown abroad for medical care.

For many, that was reminiscent of a move to arrest Sunni Vice President Tareq al-Hashemi one year ago, just when U.S. troops had withdrawn. Hashemi fled into exile and was subsequently sentenced to death in absentia.

Maliki has sought to divide his rivals and strengthen alliances in Iraq's complex political landscape before provincial elections next year and a parliamentary vote in 2014.

A face-off between the Iraqi army and Kurdish forces over disputed oilfields in the north has been seen as a possible way of rallying Sunni Arab support behind the prime minister.

Fiscal Cliff Deal Not Reached, Leaders Agree To Continue Talks

WASHINGTON -- With just three days to go before tax rates rise for all Americans and 1 trillion dollars in spending cuts over the next decade are triggered, President Barack Obama announced to the American public that the time for negotiations had not yet passed.

Several hours earlier, the president had met with top congressional leaders to discuss a path of resolution to the so-called fiscal cliff. It was, he said, a ?good and constructive discussion," one that had left him ?modestly optimistic? that a deal could still get done. But he chastised lawmakers for waiting once more until the last minute to reach an agreement.

?This is d?j? vu all over again,? he declared, adding that, ?outside of Washington, nobody understands how it is that this seems to be a repeat pattern.?

More importantly, the president declared that if Senate Majority Leader Harry Reid (D-Nev.) and Minority Leader Mitch McConnell (R-Ky.) are unable to reach a deal, he wants an up-or-down vote on a small package that would extend tax cuts for middle class Americans, continue unemployment benefits and lay the groundwork for future deficit reduction.

"The hour for immediate action is here. It is now," Obama said in a statement before the White House press corps. ?If an agreement isn?t reached in time between Sen. Reid and Sen. McConnell, then I will urge Sen. Reid to bring to the floor a basic package for an up-or-down vote.?

"So if we don?t see an agreement between the two leaders in the Senate, I expect a bill to go on the floor -- and I've asked Sen. Reid to do this -- put a bill on the floor that makes sure that taxes on middle-class families don?t go up, that unemployment insurance is still available for two million people, and that lays the groundwork, then, for additional deficit reduction and economic growth steps that we can take in the New Year," Obama added.

The action now moves to the Senate, where Reid and McConnell have precious little time to hammer out a deal. House Speaker John Boehner (R-Ohio) emphasized during Friday?s White House gathering that he would not move legislation to resolve the fiscal cliff without seeing the Senate act first.

Shortly after the White House meeting ended, Reid and McConnell appeared together on the Senate floor and said they plan to try to come up with a new proposal to present to their respective caucuses as early as Sunday.

"Whatever we come up with is going to be imperfect," Reid warned. "Some people aren't going to like it, some people will like it less. But that's where we are. We have an obligation to do the best we can."

Whether or not a Senate deal can be reached is anyone?s guess, though it seems unlikely considering all the false starts that have characterized negotiations up to this point. Whether McConnell would allow for an up-or-down vote on a Democratic-authored bill is even less certain. On Friday evening, Reid's office announced that it was preparing such a bill for a Monday vote as a contingency plan.

McConnell said the next 24 hours will be crucial if there is any deal to be had. "I am hopeful and optimistic," he said.

The framework of a Senate-blessed deal did seem to come into focus prior to the Friday meeting. Hill aides on both sides of the ledger said they could envision support for a scaled-down proposal that included tax rates extended for household income under $400,000, an extension of unemployment insurance benefits, no change to the estate tax, no money for infrastructure and no resolution to the impending debt ceiling standoff. What would happen with the $1 trillion or so in sequestration cuts set to kick in on Jan. 1, 2013 and take place over the next 10 years was unclear.

A White House official declined to say whether this would serve as the ground floor for Reid and McConnell?s talks or even if the president himself would support such a proposal. The official argued that any final deal that emerged from the Senate would have to be crafted with an eye toward garnering Democratic support in the House. Reid, after all, wouldn?t sign off on a bill that set the threshold for tax hikes too high. And since Boehner's failed "Plan B" proposal showed he was unable to pass legislation raising rates only on millionaires, Democratic votes in both chambers would be needed.

?Whatever McConnell and Reid cook up is something that Nancy Pelosi has to support," the official said. "The Minority Leader will have a powerful role in these discussions.?

The official added that the White House would be ?in touch? with Senate negotiators during the next few days to ensure that talks stayed on track. If they didn?t, and McConnell ended up filibustering even the president?s scaled-back plan, the White House feels that the hit to his reputation would be heavy.

?It puts him in a position of filibustering tax cuts for the middle class,? the official said. ?This is their incentive to get a deal done.?

The Sandy Hook shooting in Connecticut happened almost two weeks ago. The sorrow and implications of the fatal occurrence have not left the minds of most Americans.

In fact, experts have been debating over the possibility of preventing future shootings. The topic of mental illness has become most prominent in this discussion, and experts are pondering how mental health care could potentially factor into prevention of future shootings.

Gallup conducted a poll on Dec. 18, 2012, asking how effective people thought different solutions would be in preventing future mass school shootings. The most effective solutions were ?increasing the police presence at schools,? and ?increased gov?t spending on mental health screening and treatment.?

One columnist for the Christian Science Monitor suggested that there needs to be more of a focus on preventing and addressing mental health issues and social isolation, which both can contribute to mass shootings in his opinion.

Dr. David Sack, an addiction psychiatrist and CEO of Promises Treatment Centers, said in an email that he agrees better mental health care will gradually lead to less violence among the population of people with mental illnesses.

?Better community based mental health services are desperately needed and will decrease the number of mentally ill who go without treatment,? Sack said.

?Over time this will improve the integration of persons with mental illnesses into society, and decrease the risks that come from being marginalized and ostracized. Appropriate treatment reduces the risk of violent behavior.?

Tina B. Tessina, a psychotherapist and author, said in an email that stricter gun laws and greater access to mental health care could prevent future shootings problems.

?I know how difficult it is to get care for a dangerous person who refuses care,? Tessina said.

?We need to adjust the law on that ... I have worked with a number of parents of dangerous minors, and getting care for them is very difficult, expensive and emotionally painful.?

Trying to halt hepatitis C's molecular hijacking

Dec. 27, 2012 ? Researchers at the University of Colorado School of Medicine have figured out intimate details of how the hepatitis C virus takes over an invaded cell, a breakthrough that could point to way for new treatments for the virus.

Hep C hijacks the machinery by which a cell makes proteins and uses it instead to create proteins for the virus. Over the last two decades, researchers have figured out that Hep C uses an RNA molecule to do this. Now they're trying to fill in the details.

One key detail is reported in a paper published online Dec. 23 in Nature Structural and Molecular Biology. It's written by Jeffrey Kieft, PhD, an associate professor at the CU medical school's Department of Biochemistry and Molecular Genetics and an Early Career Scientist of the Howard Hughes Medical Institute, and his former graduate student, Megan Filbin, PhD, a graduate of the Program in Molecular Biology.

Working with researchers from the lab of Tamir Gonen at the Janelia Farm Research Campus of the Howard Hughes Medical Institute, Kieft used ultra high-power electron microscopes to take images of individual RNA molecules from Hep C as they interacted with the cell's machinery. The researchers combined those images with a variety of other experiments and these clues led them to identify a new way that the virus' RNAs takes over the cell's machinery.

Specifically, the researchers focused on how a ribosome, the cell's protein-making factory, can be manipulated by the Hep C RNA to affect a part of the protein process called translocation. And they saw something else -- that even very small changes in the interactions important for that hijacking process can be blocked.

"This points the way to developing drugs to fight hepatitis C in ways that current therapies do not," Kieft says.

BROOKLINE, Mass. (AP) ? Author Dennis Lehane is offering an unusual reward for the person who finds his family's beloved missing beagle.

Lehane says he'll name a character in his next book after whoever finds Tessa, who disappeared from the family's home in Brookline, Mass., this week.

He says on his Facebook page that Tessa jumped a fence at the home, and even though she has been micro-chipped, she was not wearing her tags.

Lehane says Tessa is "smart, fast, and immeasurably sweet."

Lehane wrote "Mystic River," ''Gone Baby Gone," ''Shutter Island" and other books.

ZTE has been more than willing to spill the beans about the Grand S ahead of CES, and it's not stopping with the mention that the phone exists. The Chinese phone maker has confirmed that its 5-inch smartphone measures just 6.9mm (0.27in) thick -- that's a sight slimmer than the Droid DNA and Nubia Z5. There's also mention of a 13-megapixel camera that explains a slightly visible rear hump. While we don't yet have confirmation of the rumored quad-core Snapdragon S4 Pro and 2GB of RAM, ZTE has left clues that the flagship could undercut typical pricing with a ¥2,799 ($449) off-contract cost in China. We may only know the full details in Las Vegas, but there's every indication that the Grand S hardware could justify a boast or two.

Bengals clinch playoff spot, edge Steelers 13-10

PITTSBURGH (AP) ? A.J. Green doesn't really care about the Cincinnati Bengals' woeful past. The wide receiver wasn't part of it and hasn't really taken the time to study it.

The Bengals were bad. End of story.

And now they're good. Beginning of story.

Andy Dalton hit Green for a 21-yard pass in the final minutes to set up Josh Brown's 43-yard field goal with 4 seconds left to lift the Bengals to a 13-10 win over the Pittsburgh Steelers on Sunday. Cincinnati (9-6) clinched a second straight playoff berth after beating the Steelers (7-8) for the first time since 2009. Pittsburgh (7-8) was eliminated from postseason contention.

The only other time the Bengals made the playoffs in consecutive seasons came in 1981-82, six years before Green was born.

"This has been our goal coming in at the beginning of the season," Green said. "A lot of people talked about we hadn't been in in back to back seasons in 30 years. I don't worry about that stuff. I've been here two years and we made the playoffs all two years. That's all we can control."

Shredding the label as erratic ? and sometimes comical ? losers one improbable victory at a time, the Bengals, their precocious duo of Green and Dalton and their quickly improving defense have Cincinnati in uncharted territory.

The Bengals have been around since 1968. This is the first time they'll make the postseason in two straight non-strike years.

"I know they just think that there's some complex; there's no complex, you've just got to come play and win," coach Marvin Lewis said. "This group in there has very little history of anything."

Maybe that's why Bengals aren't doomed to repeat it.

Brown missed a 56-yarder earlier in the fourth quarter, but earned a second chance when Reggie Nelson picked off Ben Roethlisberger and returned it to the Pittsburgh 46 with 14 seconds remaining. Dalton found Green down the right sideline on the next play, setting up Brown's winner.

"I've had some pretty big kicks, but that was a long time ago," said Brown, who is filling in for injured starter Mike Nugent. "When you have a chance for the playoffs there's nothing bigger. It's a big deal.

Dalton completed 24 of 41 for 278 yards and two interceptions for the Bengals, which snapped a five-game losing streak to Pittsburgh. Green caught 10 passes for 116 yards and Cincinnati's defense next let the Steelers get comfortable.

Roethlisberger completed 14 of 28 passes for 220 yards with a touchdown and two interceptions. Leon Hall returned the first pick 17 yards for a touchdown in the first quarter and Nelson stepped in front of an overthrown Roethlisberger pass in the fourth.

The Steelers needed to win their final two games to make the playoffs. Instead, the team that was 6-3 in early November will spend January at home after falling for the fifth time in its last six games.

"''We should be (in the playoffs) if it wasn't for me," Roethlisberger said after throwing his second game-deciding interception in eight days.

Roethlisberger tossed a pick ? also intended for Wallace ? on the second play of overtime in Dallas last Sunday, allowing the Cowboys to win it on a field goal. He openly questioned offensive coordinator Todd Haley's play calling after the loss, but apologized later and insisted he and Haley were "on the same page."

Maybe, but the Steelers hardly played like it. The Bengals sacked Roethlisberger four times and allowed Pittsburgh to complete just 2 of 14 third downs.

"Not our day and thus, not our year," Pittsburgh coach Mike Tomlin said. "Just not enough significant plays at the moments. Sounds like a broken record but reality as we sit here."

Pittsburgh did a decent job of keeping Dalton and Green in check, posting season highs with three turnovers and six sacks. The Bengals couldn't run the ball at all, managing just 14 yards against the NFL's top defense. Still, it wasn't enough for the Steelers, turning a season that looked so promising before Election Day into a muddled mess.

Instead of making playoff plans, Pittsburgh needs a victory next week against Cleveland to avoid the first losing season in Tomlin's six-year tenure.

Normally it's the Bengals who are playing out the string. Yet the franchise that served as a punchline for so long is now the one throwing the punches. Cincinnati never trailed in a place it rarely wins and allowed the Steelers to make the critical mistakes.

Well, most of them anyway.

Cincinnati drove into Pittsburgh territory midway through the fourth quarter with the score tied at 10 before things bogged down at the Steelers 38. Rather than try to pin reeling Pittsburgh deep, Lewis sent out Brown to attempt a 56-yard field goal into the tricky Heinz Field winds.

The kick was never close, giving the Steelers premium field position with 3:18 left.

"I make decisions to try to win the game today and they kind of backfired on me a little bit," Lewis said.

Pittsburgh, however, had its own kicking issues. The Steelers moved to the Cincinnati 36, then brought out Shaun Suisham for a 53-yard attempt that was short all the way.

The Bengals went nowhere, giving Pittsburgh one last shot in regulation. Rather than run out the clock and play for overtime with the ball at their own 11 and 44 seconds to go, the Steelers tried to make something happen.

And they did. For the Bengals. Facing second down at the Pittsburgh 29, Roethlisberger rolled to his right and tried to hit Wallace down the sideline. The ball sailed over Wallace's head and into Nelson's arms.

Last week, at Seattle?s Newground Social Investment holiday party, the firm?s Foundernew and used guns Bruce Herbert, a leader in SRI, gave a toast in which he applauded Bill McKibben?s?leadership in fossil fuel divestiture. Herbert asked the crowd to support McKibben?s efforts, both in attending events (Herbert attended McKibben?s ?Do The Math? divestiture launch) and in our investment practices.

At first, I was thrilled. I wondered if the Do The Math campaign had already spread beyond college campuses to the broader SRI investment community. If so, the movement was spreading even faster than I could have hoped.

?

Four days later in Newtown Connecticut, a 20-year-old gunman trained a semi-automatic gun on a 2nd grade classroom, killing 20 small children and 6 adults. In the midst of writing about fossil fuel divestiture, I realized there was something bigger going on: despite all the successes the SRI industry can claim, it has been a failure when it comes to products that kill.

?

SRI was first practiced by religious groups who refused to invest their money in companies whose products were harmful to their congregations, mostly alcohol, tobacco and gambling. These ?sin? screens have been in place for at least sixty years. Later, other screens were commonly added for harmful industries such as pornography, weapons and the military. But none of these industries has been seriously affected by SRI.

?

This is not to undercut the work that SRI has done. Over the years, it has played an important role in anti-war, anti-nuclear, environmental movements, civil rights and economic justice, including most famously apartheid.

?

But as Robert Zevin, an early SRI advocate, says in a blog for Huffington Post, SRI?s original moral purpose has been subsumed to profit:

?

?Many of us are now embarrassed to say that our religious or moral or political views should and do affect our investment selections. We know the gatekeepers don?t want to hear it; and they know that many of their institutional clients definitely don?t want to hear it.?

?

And investors have even less influence when they simply refuse to invest. The old guard of SRI would hold stocks just to give them a seat at the table ? or rather, at the annual corporate meeting. Now, even investors as socially minded as the Gates Foundation are interested in only one thing: returns. That Foundation may do worlds of good for global health, but its biggest investments after Berkshire Hathaway are in McDonald?s and Coca Cola, two companies most at odds with children?s health.

?

At least sixty years of investors boycotting the gun trade has yielded zero result. In fact, SRI activism works best when rewarding companies that care about being good, whose products sustain life rather than take it. For example, CSRHub, the social responsibility data aggregator, created a special issue called ?NRA Anti-Gun List? so that CSR executives can support companies that take a stand against guns, rather than providing a list of gun manufacturers and dealers to boycott.

?

Only new regulations prompted by consumer outrage will restrict guns. I fear the same is true for climate change. Noble a thought as it is ? and as much as we all love having an outlet for our outrage ? the truth is, divestiture itself will have as little effect as investment screens for guns. But the moral outrage that the campaign is sparking, like the moral outrage sparked by the massacre in Newtown, is a different story. I look forward to restrictions and even bans being enacted at all levels of government on both guns and fossil fuels. Investors and consumers can take care of keeping the responsible companies in line. I am thankful we have other means to handcuff the really bad businesses.

Justice reaches settlement with Penguin on e-books

(AP) ? The Justice Department announced Tuesday it has reached a settlement with Penguin Group (USA) Inc. in its lawsuit accusing the nation's largest book publishers of colluding with Apple Inc. to raise e-book prices on customers.

The settlement, if approved by a federal judge, leaves Apple and Holtzbrinck Publishers LLC, which does business as Macmillan, as the only defendants standing against the federal government's charges that Apple, the multimedia and computer giant, conspired with several publishers in the fall of 2009 to force e-book prices several dollars above the $9.99 charged by Amazon.com on its popular Kindle device.

The Justice Department, which sued in April, settled with Hachette Book Group, Inc., HarperCollins Publishers LLC and Simon & Schuster Inc. earlier this year. The trial is scheduled to begin in June.

"The proposed settlement with Penguin will be an important step toward undoing the harm caused by the publishers' anticompetitive conduct and restoring retail price competition so consumers can pay lower prices for Penguin's e-books," said Jamillia Ferris, chief of staff and counsel at the Justice Department's antitrust division.

Apple Inc. has said the government's accusation that it conspired with major book publishers to raise the price of e-books is untrue.

The proposed settlement was filed in federal court in New York.

The settlement had been expected by some industry observers as a means to simplify Penguin's impending merger with Random House, which is not a defendant in the case. That deal would create the world's largest publisher of consumer books.

Under the settlement, Penguin "will be prohibited for two years from entering into new agreements that constrain retailers' ability to offer discounts or other promotions to consumers to encourage the sale of the Penguin's e-books," and must submit to "a strong antitrust compliance program" that includes telling federal officials about any joint e-book ventures or any communications with other publishers, Justice Department officials said.

The Justice Department's lawsuit stems from agreements reached between major publishers and Apple in 2010 that allowed publishers to set their own prices for e-books, an effort to counter Amazon's deep discounts of best sellers. The department and 15 states said Apple and the publishers cost consumers more than $100 million in the past two years by adding $2 or $3, sometimes as much as $5, to the price of each e-book.

E-books are believed to comprise around 25-30 percent of total book sales.

Penguin Books is scheduled to merge with Random House, which is owned by German media company Bertelsmann. The resulting combination will have around a quarter of the market for consumer books. "Should the proposed joint venture proceed to consummation, the terms of Penguin's settlement will apply to it," the department said.

Last week, the European Union's competition watchdog accepted proposals by four publishers and Apple to end agreements that set retail prices for e-books ? a practice the EU feared violated competition rules. The agreement was legally binding on Hachette Livre; Harper Collins; Simon & Schuster; and Verlagsgruppe Georg von Holtzbrinck, which owns Macmillan. That deal was also binding on Penguin.

Stocks open higher as budget talks move ahead

Stocks are opening slightly higher on Wall Street as both sides make concessions in budget talks in Washington.?

The Dow Jones industrial average rose 17 points to 13,252 shortly after the opening bell Tuesday. The Dow rose 100 points the day before.?

The Standard & Poor's 500 index rose two points to 1,432,?extending a rally that lifted the S&P 500 to its highest in nearly two months. The Nasdaq composite rose 10 to 3,020.?

President Barack Obama offered to raise the income level at which higher tax rates would kick in and lowered his 10-year goal for increasing tax revenue. That followed an offer from House Speaker John Boehner to raise taxes on the wealthy.?

Investors have been reluctant to make big bets in the face of uncertainty over the cliff, a combination of steep tax hikes and spending cuts that could hurt the U.S. economy if they take effect next year.?

But hopes for a deal grew Monday night as Obama made a counter-offer to Republicans that included a major change in position on tax hikes for the wealthy, according to a source familiar with the talks.?

The report followed a meeting between Obama and Boehner, who has edged closer to Obama's position by proposing higher taxes on those who earn $1 million or more and extending lower tax rates for everyone else.?

Many investors fear that going over the fiscal cliff could push the U.S. economy back into recession.?

"Neither side appears to be digging in their heels so much, and that increases the optimism there might be a deal," said Oliver Pursche, president of Gary Goldberg Financial Services in Suffern, New York. "Political risks have been the main thing suppressing market gains, so if those abate we could see a rally that is significant."?

Arbitron surged 24 percent to $47.31 in premarket trading after Nielsen Holdings agreed to buy the media and marketing research firm in a deal worth $1.26 billion. Nielsen rose 3 percent to $30.50 before the bell.?

Proposed DSM-5 Criteria May Unfairly Label Physical Conditions as ...

Recently in the IBS and chronic illness community, several professionals and self-advocates have begun expressing concern about proposed changes in the Diagnostic and Statistical Manual for Mental Disorders, commonly known as the DSM. This is a lengthy reference book published by the American Psychological Association as a guide for mental health professionals in diagnosing their clients or patients according to standard criteria. The DSM is revised periodically and the 5th edition is expected to be released in 2013. While there are many controversial proposed changes, one that has received relatively little attention in the mainstream media is particularly alarming in its potential implications for people with chronic illnesses, especially ones that are still scientifically poorly understood, like irritable bowel syndrome or commonly overlapping conditions like fibromyalgia, chronic fatigue syndrome and interstitial cystitis among others.

According to Suzy Chapman, a health advocate in the United Kingdom in her article, ?Somatic Symptom Disorder Could Capture Millions More Under Mental Health Diagnosis,? it is proposed that four separate and stricter diagnostic categories currently in the DSM-4 be revised to a single? umbrella diagnosis in the DSM-5 to be named ?Somatic Symptom Disorder.? As paraphrased in ?Mislabeling Medical Illness as Mental Disorder? by Allen Frances, MD in the U.S. magazine Psychology Today, Chapman writes in part:

?A person will meet the criteria for SSD by reporting just one bodily symptom that is distressing and/or disruptive to daily life and having just one of the following three reactions to it that persist for at least six months: 1) ?disproportionate? thoughts about the seriousness of their symptom(s); or 2) a high level of anxiety about their health; or, 3) devoting excessive time and energy to symptoms or health concerns.?

As noted by both Chapman and Dr. Frances, as well as Tiffany Taft, PsyD of Northwestern University and Oak Park Behavioral Medicine, whose psychotherapy practice specializes in IBS, inflammatory bowel disease and other chronic medical conditions, these criteria are extremely broad, very subjective according to the personal definitions and potential biases of an individual mental health professional, and could potentially be interpreted to encompass almost anyone with a disruptive chronic illness, even a relatively well-defined one such as cancer, diabetes, rheumatoid arthritis or life-threatening food allergy, at a given point in time. In many situations, the person may be expressing typical and understandable stress or grief related to chronic pain or other ongoing symptoms or risks.? In her own blog post on this subject, ?Moving In the Wrong Direction,? Dr. Taft also raises concern that normal emotional reactions of a parent or caregiver of a child with a chronic illness may be pathologized as well.

Specific to IBS and commonly overlapping or other complex functional syndromes, Dr. Frances quotes Chapman:

?The Work Group is not proposing to classify Chronic Fatigue Syndrome, Irritable Bowel Syndrome, and Fibromyalgia within the DSM-5 ?Somatic Symptom Disorders? section, but these patients and others with conditions like chronic Lyme disease, interstitial cystitis, Gulf War illness and chemical injury will now become particularly vulnerable to misdiagnosis with a DSM-5 mental health disorder. In the field trials, more than one in four of the irritable bowel and chronic widespread pain patients who comprised the ?functional somatic? study group were coded for ?Somatic Symptom Disorder.?

Dr Frances, who is listed in his article as the chair of the task force for the DSM-4, former chair of the Department of Psychiatry and current Professor Emeritus at Duke University School of Medicine, agrees that this new proposed diagnosis of Somatic Symptom Disorder may encourage a premature rush to label a person?s medical condition as ?all in the head.?

This disconcerting possibility is not unfounded. Historically, because IBS shows no overt biological markers that can be discerned by existing tests available to clinicians outside of highly specialized functional gastrointestinal research labs, it was long believed that there was nothing physically wrong with people with IBS. Ongoing research worldwide over the past 20-30 years has increasingly disproved that assertion, but widespread stereotypes and misconceptions remain.? Many people who have had IBS for some time can anecdotally recall at least one relative, acquaintance or health care professional who told them that IBS was ?all in the head? or similar dismissive comments, and even many people with IBS themselves continue to believe that IBS? is ?caused? by emotional stress rather than, more accurately, potentially worsened by stress depending on the situation and the individual. As IBS Impact wrote on this blog on October 9, 2011, a study conducted by UCLA in 2010 showed that compared to an international group of functional GI disorder experts, considerably more gastroenterologists, primary care physicians and nurse practitioners in local communities still support the outdated notion that IBS is a diagnosis to be given only when all other possible disorders are ruled out. In addition, Dr Taft?s research interests focus on stigma in gastrointestinal disorders. She and her colleagues at Northwestern, in cooperation with Olafur Palsson, PsyD at the University of North Carolina Center for Functional GI and Motility Disorders, have found that study participants with IBS or inflammatory bowel disease both perceive stigma, but those with IBS perceive more. Dr. Taft?s blog post linked here includes links to the abstracts of her team?s published results for both groups.

It is hoped that there will be further revisions to this portion of the DSM-5 before the final version is released, but at this time, there is no clear information as to if this is planned. Regardless of the outcome, this situation underscores once again why it is important for those of us with chronic, poorly understood conditions like IBS, our loved ones, and the professionals who support us to make conscious efforts to begin or continue public awareness and advocacy about the realities of life with IBS , even if it requires stepping out of our initial comfort zones. If we do not speak out against this slippery slope, we risk even further invisibility and stigmatization in the future.

Kim Jong Il Death Anniversary: North Korea Displays Deceased Leader One Year After His Death

PYONGYANG, North Korea ? North Korea unveiled the embalmed body of Kim Jong Il, still in his trademark khaki jumpsuit, on the anniversary of his death Monday as mourning mixed with pride over a recent satellite launch that was a long-held goal of the late authoritarian leader.

Kim lies in state a few floors below his father, national founder Kim Il Sung, in the Kumsusan mausoleum, the cavernous former presidential palace. Kim Jong Il is presented lying beneath a red blanket, a spotlight shining on his face in a room suffused in red.

Wails echoed through the chilly hall as a group of North Korean women sobbed into the sashes of their traditional Korean dresses as they bowed before his body. The hall bearing the glass coffin was opened to select visitors ? including The Associated Press ? for the first time since his death.

North Korea also unveiled Kim's yacht and his armored train carriage, where he is said to have died. Among the personal belongings featured in the mausoleum are the parka, sunglasses and pointy platform shoes he famously wore in the last decades of his life. A MacBook Pro lay open on his desk.

North Koreans paid homage to Kim and basked in the success of last week's launch of a long-range rocket that sent a satellite named after him to space.

The launch, condemned in many other capitals as a violation of bans against developing its missile technology, was portrayed not only as a gift to Kim Jong Il but also as proof that his young son, Kim Jong Un, has the strength and vision to lead the country.

The elder Kim died last Dec. 17 from a heart attack while traveling on his train. His death was followed by scenes of North Koreans dramatically wailing in the streets of Pyongyang, and of the 20-something son leading ranks of uniformed and gray-haired officials through funeral and mourning rites.

The mood in the capital was decidedly more upbeat a year later, with some of the euphoria carrying over from last Wednesday's launch. The satellite bears one of Kim Jong Il's nicknames, Kwangmyongsong, or "Lode Star," a moniker given to him at birth according to the official lore.

Cameras were not allowed inside the mausoleum, and state media did not release any images of Kim Jong Il's body.

With the death anniversary came a hint that Kim Jong Un himself might soon be a father.

His wife, Ri Sol Ju, was seen on state TV with what appeared to be a baby bump as she walked slowly next to her husband at the mausoleum, where they bowed to statues of Kim's father and grandfather.

There is no official word from Pyongyang about a pregnancy. In addition, Ri is shown wearing a billowing traditional Korean dress in black that makes it difficult to know for sure.

North Koreans are reluctant to discuss details of the Kim family that have not been released by the state. Still there are rumors even in Pyongyang about whether the country's first couple is expecting.

To honor Kim's father, North Koreans stopped in their tracks at midday and bowed their heads as the national flag fluttered at half-staff along streets and from buildings.

Pyongyang construction workers took off their yellow hard hats and bowed at the waist as sirens wailed across the city for three minutes.

Tens of thousands of North Koreans gathered in the frigid plaza outside, newly transformed into a public park with lawns and pergolas. Geese flew past snow-tinged firs and swans dallied in the partly frozen moat that rings the vast complex in Pyongyang's outskirts.

"Just when we were thinking how best to uphold our general, he passed away," Kim Jong Ran said at the plaza. "But we upheld leader Kim Jong Un. ... We regained our strength and we are filled with determination to work harder for our country."

Speaking outside the mausoleum, renamed the Kumsusan Palace of the Sun, the military's top political officer, Choe Ryong Hae, said North Korea should be proud of the satellite, calling it "a political event with great significance in the history of Korea and humanity."

Much of the rest of the world, however, was swift in condemning the launch, which was seen by the United States and other nations as a thinly disguised cover for testing missile technology that could someday be used for a nuclear warhead.

The test, which potentially violates a United Nations ban on North Korean missile activity, underlined Kim Jong Un's determination to continue carrying out his father's hardline policies even if they draw international condemnation.

Some outside experts worry that Pyongyang's next move will be to press ahead with a nuclear test in the coming weeks, a step toward building a warhead small enough to be carried by a long-range missile.

Despite inviting further isolation for his impoverished nation and the threat of stiffer sanctions, Kim Jong Un won national prestige and clout by going ahead with the rocket launch.

At a memorial service on Sunday, North Korea's top leadership not only eulogized Kim Jong Il, but also praised his son. Kim Yong Nam, president of the Presidium of North Korea's parliament, called the launch a "shining victory" and an emblem of the promise that lies ahead with Kim Jong Un in power.

The rocket's success also fits neatly into the narrative of Kim Jong Il's death. Even before he died, the father had laid the groundwork for his son to inherit a government focused on science, technology and improving the economy. And his pursuit of nuclear weapons and the policy of putting the military ahead of all other national concerns have also carried into Kim Jong Un's reign.

In a sign of the rocket launch's importance, Kim Jong Un invited the scientists in charge of it to attend the mourning rites in Pyongyang, according to state media.

The reopening of the mausoleum on the anniversary of the leader's death follows tradition. Kumsusan, the palace where his father, Kim Il Sung, served as president, was reopened as a mausoleum on the anniversary of his death in 1994.

San Francisco Zoo Introduces the 'Jingle Penguins'

The San Francisco Zoo released this video of penguins singing "Jingle Bells" in honor of their first-ever zoo lights celebration.

"A few months ago I got a call from a sound producer at Skywalker Sound," Abbie Tuller, San Francisco Zoo communications director, told ABC News. "He was hoping to come to the zoo to capture some sounds of the animals. I said, 'Absolutely.' The penguins are some of our most vocal animals. We had this idea for the 'Jingle Penguins.'"

Tuller asked whether the producer could take live sounds from the penguins and edit them into the "Jingle Bells" tune. He obliged, and now the YouTube video has nearly 1,300 views since it was originally posted Nov. 29.

The penguins are part of the only colony of Magellanic penguins in captivity. The San Francisco Zoo has a successful breeding program.

"The Magellanic penguin's common name comes from the Straits of Magellan, a series of waterways at the southern tip of South America, where this species of penguin can be found," according to the zoo's website.

"We have a genius video editor on staff and she edited the video together with his sounds. The penguins are lip-syncing," Tuller joked.

She added, "We really like it, but you're never sure if you've nailed it or not. But we're getting a great response. People just go kooky over penguins."
